This document explains the terms and policies that apply when you use our website, contact us, or engage with our services. Please read it carefully.
Scope of This Policy
Code Tech Agency supplies digital services such as websites, web and mobile applications, e-commerce solutions, integrations, automation, and separately agreed technical support or maintenance. Our work is generally quoted for each client rather than sold as a physical product.
This policy applies to payments made for our services, alongside the accepted quotation or project agreement and our Terms & Conditions. Where mandatory South African consumer law gives you stronger rights, those rights take precedence over this policy and any project terms.
Deposits and Work Not Yet Started
Some projects require an upfront deposit. The amount, milestones and scope will be stated in the quotation or agreement before payment.
If you request cancellation before work begins, we will review the payment and any specifically agreed, lawful, already-incurred third-party costs. We will refund amounts that remain payable to you under the agreement or applicable law. We do not automatically treat every deposit as non-refundable.
Work in Progress or Already Delivered
If a project is cancelled after development, design, discovery or other agreed work has started, we will provide a reasonable breakdown of completed work, approved milestones, and any non-recoverable third-party expenses that were agreed in advance. Any refundable balance will be calculated in accordance with the contract and the law.
If delivered services are materially different from the agreed scope or do not meet applicable legal standards, contact us so that we can assess an appropriate remedy. Depending on the circumstances and your statutory rights, this may include correction, further performance, a partial refund or a full refund.
Statutory Cooling-Off and Consumer Rights
For qualifying South African electronic transactions, section 44 of the Electronic Communications and Transactions Act provides a seven-day cooling-off right for services, running from the conclusion of the agreement. A qualifying cancellation carries a right to a full refund within 30 days of cancellation.
The Act includes exceptions, including services that began with the consumer's consent before the seven-day period ended. The exception is not assumed merely because a deposit was paid. Other rights under the Consumer Protection Act and applicable law may also apply.
Hosting, Maintenance and Retainer Payments
Hosting arrangements, website maintenance, search optimisation or support retainers are optional and are only charged where separately agreed. The accepted service agreement sets out the price, billing frequency and included services.
On cancellation, we will stop future charges from the effective cancellation date and review prepaid unused periods under the agreement and applicable law. Completed service periods and properly authorised third-party costs will be considered fairly, without limiting any consumer rights.
See our Cancellation Policy for how to request a cancellation.
How to Request a Refund
Submit a request through our Contact page or, if you are an existing client, our Support page. Please provide the name used for the booking or payment, a reference or invoice number, the service purchased, and the reason for the request. Do not send payment-card details.
We will review the request, may seek relevant information about work already performed, and communicate the outcome and any calculation in writing. You may ask for a review of the decision.
Refund Processing and Payment Method
Approved refunds are ordinarily returned using the original payment method, where supported by the payment provider. Actual banking or payment-provider processing times may vary.
We will meet any legally required refund deadline, including the 30-day deadline for qualifying cancellations under section 44 of the Electronic Communications and Transactions Act. Nothing here removes a right to dispute a payment with your bank or payment provider.
